TERMS AND CONDITIONS

The following are the Terms and Conditions (hereafter referred to as T & C) according to which a visitor, member or user (hereafter referred to as Service User) agrees to avail of Synergyst’s services. Please make sure that you have read the T & C fully and that you understand everything before you use Synergyst’s services. Use of Synergyst’s services indicates full understanding and acceptance of as well as full consent to the T & C in its entirety. If you have any objection to any part of the T & C, please refrain from using Synergyst’s services.

Synergyst provides the Service User access to market research data, research materials, research reports, and other information and resources to which Synergyst has license or right of ownership.

Intellectual Property Rights on Synergyst Provided Content

Service User accepts that use of Synergyst’s products and materials is subject to copyright laws. Service User agrees that the information gained from Synergyst provided content cannot be redistributed or disseminated without written permission from Synergyst. To request the written permission to redistribute or disseminate licensed or proprietary information, Service User must file a written request with Synergyst. If written permission is granted by Synergyst, it is understood that the Service User has permission to redistribute or disseminate only content and information specified in the written permission. Service User will refrain from redistributing and disseminating any information and content not specifically declared in the written permission.

The names, logos, icons and graphics used on this website in connection with or identifying our products and/or services are proprietary marks of Synergyst unless otherwise indicated. Your access does not imply a licence to reproduce, transmit and/or distribute this information or these names, logos, icons and graphics in any form or by any means. If you wish to do any of these things, Service User must file a written request with Synergyst.

Product Delivery

No report will be dispatched to the Service User until Synergyst receives complete payment for it. Ordered reports will be immediately dispatched on receiving payment receipt confirmation from the payment gateway – 2Checkout. This process usually takes 2-3 working days. However, Synergyst is not responsible for any delay or any postponement caused due to reasons beyond our control. In case of hard copy and CD-ROM orders, reports will be dispatched using the best possible courier service available to us. Costs of shipping and courier are already included in the prices for these formats.

Refund and Return Policy

The Service User is advised to read all the information about the report or any other product purchased from the Synergyst website before placing an order. Order once placed, will not be cancelled. So we suggest, if you have any queries about any product or service then please contact Synergyst and ensure that you have all the information about that product or service before making any payment for it. Due to the nature of our business and the products that are being sold, it is not possible for us to entertain any returns and/or refunds. Products once sold, will not be returned and no monetary refunds will be made.

Third Party Links

Synergyst, in order to provide increased functionality and better service to its Service Users, may display links to the websites of other service providers, institutions, organisations, and business entities that may or may not be affiliated with Synergyst. It must be understood that Synergyst cannot control the content, information, data, and materials displayed on any of these websites. It must be further agreed that these websites have their own privacy terms, conditions and agreements and that Synergyst may not be held liable for damages and issues arising from these third-party websites’ information-collection procedures and privacy policies.

Pornographic Content

The Service User must refrain from uploading or submitting pornographic content to Synergyst. Synergyst reserves the right to remove any content that qualifies as mature, adult, sexually explicit, or pornographic according to commonly accepted standards and relevant federal and state laws.

Disclaimer of Warranty; Limitation of Liability

Synergyst does not warrant continuous or uninterrupted service; nor does it guarantee the accuracy, validity, veracity, and reliability of any content, information, data, and materials that can be accessed through Synergyst. The Service User agrees that he or she accesses and uses Synergyst at his or her own discretion and risk.

Synergyst is not liable for any and all damages that arise from service failures, service defects, service interruptions, access errors, oversight, incomplete content, inaccurate information, imprecise data, altered information, computer virus transmission and attacks, internet fraud, identity theft, unauthorised access to user accounts, and alteration of user-provided content caused by carelessness, violation of the T&C or any other cause. The Service User also agrees and accepts that Synergyst cannot be held liable for any and all damages resulting from the opinions and information expressed and submitted by Service Users as well as for Service Users’ conduct and behaviour.

It is agreed that this disclaimer of warranties and liabilities is applicable to all content, information, data and materials accessible through and distributed by Synergyst. We do not endorse, support, recommend, warrant, or guarantee the accuracy, validity, veracity, and reliability of all opinions, information, data, advice, offers, and statements made in all content accessible through Synergyst. Thus, under no instance can Synergyst be held liable for any and all damages such as loss of profits that result from the access and use of Synergyst or from reliance on opinions, information, data, advice, offers, and statements gained through Synergyst.

Synergyst, furthermore, does not endorse, support, recommend, warrant, or guarantee the accuracy, validity, veracity, and reliability of all opinions, information, data, advice, offers, and statements made by third parties and Service Users through Synergyst. We shall not be responsible for monitoring, regulating or enforcing transactions or agreements among Service Users and third parties. The Service User agrees that he or she will transact business or interact with other Service Users and third parties at his or her own discretion and risk. It is further agreed that under no instance can Synergyst, its employees, its agents, and its affiliates be held liable for any and all damages arising from the use and choice of any third-party browser, the download of any third-party utility or product, or use and choice of any third-party service.

Policy Changes

Please be aware that it is the prerogative of Synergyst to change the T&C when necessary. Synergyst, it is further agreed, is under no obligation to inform you of such changes. It remains the sole responsibility of the Service User to check the T&C from time to time to check for any changes.
